Acceptable Use Policy

This Acceptable Use Policy (“Policy”) explains the rules that apply when you access or use Mellow’s website, web application, rooms, focus tools, subscriptions, Focus Points, rewards, and related services (collectively, the “Service”).

This Policy forms part of Mellow’s Terms of Service.

By using Mellow, you agree not to misuse the Service or interfere with other users, Mellow’s systems, or Mellow’s business operations.

1. General Rule

You may use Mellow only for lawful, personal, and authorized purposes.

You may not use Mellow in a way that:

• Violates applicable law
• Violates another person’s rights
• Circumvents Mellow’s access controls
• Interferes with the operation of the Service
• Creates security, fraud, financial, or technical risk
• Abuses Mellow’s subscription, Focus Point, reward, or account systems

2. Unauthorized Access

You may not attempt to gain unauthorized access to:

• Another user’s account
• Mellow administrative systems
• Databases
• APIs
• Servers
• Authentication systems
• Payment systems
• Subscription controls
• Source code repositories
• Infrastructure
• Internal tools
• Non-public features

You may not use stolen credentials, session tokens, cookies, authentication tokens, or other credentials belonging to another person.

3. Account Abuse

You may not:

• Create accounts using false or misleading identities for fraudulent purposes
• Impersonate another person or organization
• Access another user’s account without permission
• Sell, rent, transfer, sublicense, or commercially distribute your account
• Share an account in a way designed to avoid subscription requirements
• Create excessive accounts to exploit promotions, Focus Points, rewards, or access restrictions
• Use automated systems to create accounts at scale
• Attempt to evade account suspension or termination by creating another account

4. Subscription and Premium Access Abuse

Mellow may restrict certain rooms, features, rewards, or functionality to Premium subscribers.

You may not:

• Circumvent Premium restrictions
• Modify your account to falsely indicate an active Premium subscription
• Manipulate subscription status
• Alter client-side data to unlock Premium content
• Forge payment or subscription confirmations
• Exploit a billing error to retain unauthorized Premium access
• Use another person’s Premium access without authorization
• Bypass Stripe, Mellow’s billing controls, or other subscription systems
• Redistribute or resell Premium access

If Mellow discovers unauthorized Premium access, it may remove that access and take appropriate action against the associated account.

5. Focus Point and Reward Manipulation

Mellow may provide Focus Points (“FP”), achievements, unlocks, companion rewards, room access, and other virtual progress systems.

You may not manipulate these systems through unauthorized means.

Prohibited conduct includes:

• Artificially generating FP
• Editing stored FP values
• Modifying client-side code to increase FP
• Exploiting bugs to earn excessive FP
• Using bots or scripts to automate FP earning
• Repeatedly triggering actions solely to exploit a reward mechanism
• Manipulating achievement completion
• Falsifying focus-session completion
• Duplicating virtual rewards
• Bypassing FP requirements for locked content
• Transferring FP between accounts unless Mellow expressly permits it
• Selling or exchanging FP or virtual rewards for money or other value

Mellow may correct FP balances, achievements, unlocks, or progress when there is reasonable evidence of manipulation, fraud, or technical error.

6. Bugs and Exploits

If you discover a bug, vulnerability, unintended behavior, or exploit, you may report it to Mellow.

You may not knowingly use a bug or vulnerability to:

• Obtain unauthorized access
• Unlock Premium content
• Generate FP or rewards
• Access another user’s data
• Avoid payment
• Damage Mellow
• Interfere with other users
• Extract confidential information
• Escalate account permissions
• Disrupt the Service

Limited good-faith testing intended solely to identify and responsibly report a security issue may be treated differently where permitted by law, provided it does not cause harm, access unnecessary user data, or disrupt the Service.

7. Automated Use

Unless Mellow expressly authorizes it, you may not use:

• Bots
• Crawlers
• Scrapers
• Automated scripts
• Headless browsers
• Macros
• Automated account systems
• Automated data-extraction tools

to interact with Mellow in a manner that exceeds ordinary personal use.

This includes automation intended to:

• Earn FP
• Complete achievements
• Unlock rewards
• Create accounts
• Extract content
• Monitor protected functionality
• Reproduce Mellow’s database
• Avoid subscription restrictions
• Generate artificial activity

Ordinary accessibility technologies and legitimate browser functionality are not prohibited by this section.

8. Scraping and Data Extraction

You may not systematically scrape, copy, harvest, extract, index, download, or reproduce Mellow content or data without authorization.

This includes:

• Room designs
• Written content
• Audio
• Visual assets
• Animations
• User interface elements
• Icons
• Graphics
• Reward structures
• Feature data
• Pricing data collected at scale
• User information
• Internal endpoints
• Database content

Public search-engine indexing performed in accordance with Mellow’s technical settings is not considered prohibited scraping.

9. Reverse Engineering

Except where applicable law expressly gives you a non-waivable right to do so, you may not:

• Reverse engineer
• Decompile
• Disassemble
• Decode
• Derive source code
• Circumvent technical protection measures
• Attempt to discover private algorithms
• Attempt to reconstruct non-public service architecture

for Mellow or its protected components.

You may not use technical inspection for the purpose of copying Mellow’s protected functionality or circumventing access restrictions.

10. Security Abuse

You may not:

• Probe Mellow’s systems for vulnerabilities without authorization
• Perform penetration testing without permission
• Scan ports or infrastructure without authorization
• Attempt credential stuffing
• Attempt password spraying
• Attempt session hijacking
• Attempt authentication bypasses
• Attempt privilege escalation
• Intercept private communications
• Manipulate requests to gain unauthorized access
• Exploit server, database, or application vulnerabilities
• Attempt to disable or evade security controls

11. Malware and Harmful Code

You may not introduce, transmit, distribute, upload, or attempt to execute:

• Malware
• Viruses
• Trojans
• Worms
• Ransomware
• Spyware
• Malicious scripts
• Destructive code
• Unauthorized cryptocurrency miners
• Code designed to steal credentials
• Code designed to damage systems

through or against Mellow.

12. Service Disruption

You may not intentionally interfere with the availability or performance of Mellow.

Prohibited conduct includes:

• Denial-of-service attacks
• Distributed denial-of-service attacks
• Excessive automated requests
• Deliberate server overload
• Repeated malformed requests intended to disrupt operation
• Interference with network infrastructure
• Attempts to disable features for other users

13. Fraudulent Conduct

You may not use Mellow to engage in fraud or deceptive activity.

This includes:

• Fraudulent purchases
• Stolen payment methods
• False refund claims
• False chargebacks
• Manipulation of billing systems
• Misrepresentation of account ownership
• Use of Mellow to facilitate financial fraud
• Attempts to obtain services without paying where payment is required

Legitimate billing disputes and lawful chargebacks are not prohibited.

14. Payment Abuse

You may not knowingly:

• Use a payment method without authorization
• Submit stolen financial information
• Repeatedly initiate purchases solely to exploit refunds
• Abuse promotional pricing
• Manipulate checkout processes
• Falsify transaction results
• Attempt to bypass payment authentication
• Exploit payment processing errors

Mellow may suspend access while suspected payment abuse is investigated.

15. Chargeback Abuse

Users retain the right to dispute charges through lawful payment channels.

However, you may not knowingly initiate a false or fraudulent chargeback after receiving the paid service solely to avoid payment.

Where Mellow reasonably determines that a chargeback was fraudulent or abusive, the account may be suspended or terminated.

16. Intellectual Property Misuse

You may not use Mellow’s intellectual property beyond the limited rights granted in the Terms of Service.

Without authorization, you may not:

• Copy Mellow’s rooms for commercial use
• Republish Mellow artwork
• Repackage Mellow audio
• Redistribute animations
• Reproduce the interface as a competing product
• Sell Mellow assets
• Claim ownership of Mellow branding
• Remove copyright or proprietary notices
• Use Mellow’s logo in a misleading way
• Create counterfeit Mellow services

17. Competitive Copying

You may not systematically use Mellow for the purpose of reproducing a substantially similar commercial service through unauthorized copying of protected Mellow content, design assets, source code, or other proprietary material.

This does not prohibit lawful competition, independent development, or use of ideas that are not protected by intellectual-property law.

18. User Content

If Mellow later allows users to submit, upload, post, save, or share content, users may not use those features to distribute unlawful or abusive material.

This may include content that:

• Violates intellectual-property rights
• Contains malware
• Facilitates fraud
• Contains unlawful threats
• Exploits minors
• Violates privacy rights
• Is otherwise illegal

If Mellow does not currently offer user-generated content features, this section does not create such functionality.

19. Harassment and Abuse

If Mellow introduces social, shared, messaging, community, or collaborative features, you may not use them to:

• Harass other users
• Threaten others
• Stalk users
• Dox users
• Share private information without permission
• Coordinate targeted abuse
• Impersonate others
• Facilitate unlawful discrimination or abuse

20. Illegal Activity

You may not use Mellow to plan, facilitate, conceal, or carry out illegal activity.

This includes using the Service in connection with conduct that violates applicable criminal, civil, financial, privacy, intellectual-property, or cybersecurity laws.

21. Safety

You may not use Mellow in a manner that creates an unreasonable safety risk.

For example, you should not interact with Mellow while:

• Driving
• Operating dangerous machinery
• Performing tasks requiring your uninterrupted attention
• Engaging in an activity where audio or visual distraction would create a hazard

22. Misrepresentation of Mellow

You may not falsely represent that:

• You work for Mellow
• You are an authorized Mellow representative
• Mellow endorses you
• Mellow sponsors your product or service
• Your service is an official Mellow product
• You have a partnership with Mellow when none exists

23. Domain, Brand, and Identity Abuse

You may not use Mellow’s branding, trade dress, logos, or confusingly similar identifiers in a way designed to impersonate Mellow or mislead users.

This includes creating misleading:

• Websites
• Login pages
• Social accounts
• Applications
• Payment pages
• Support accounts
• Promotional material

that falsely appear to be operated by Mellow.

24. Phishing

You may not use Mellow or Mellow-related branding to:

• Steal passwords
• Obtain payment credentials
• Obtain authentication tokens
• Impersonate support
• Trick users into revealing private information
• Redirect users to fraudulent login or payment pages

25. Privacy Violations

You may not use Mellow to unlawfully access, collect, disclose, or distribute another person’s personal information.

You may not attempt to identify, expose, or obtain private user information beyond what Mellow intentionally makes available to you.

26. Excessive or Abusive Requests

Mellow may impose reasonable technical limits to protect performance and security.

You may not intentionally evade those limits or generate excessive traffic designed to:

• Consume unreasonable resources
• Increase infrastructure costs
• Degrade performance
• Disrupt service availability
• Prevent normal use by others

27. Circumvention of Technical Restrictions

You may not intentionally circumvent:

• Rate limits
• Authentication checks
• Subscription checks
• FP requirements
• Feature locks
• Geographic restrictions
• Security controls
• Account restrictions
• API limits
• Device restrictions

unless expressly authorized by Mellow.

28. Unauthorized Commercial Use

Unless Mellow expressly authorizes it, your access to Mellow is for personal use.

You may not:

• Resell access
• Operate a paid Mellow access service
• Bundle Mellow access into another paid product
• Charge others to access your account
• Commercially redistribute Mellow content
• Use Mellow assets in paid products

without written permission.

29. Enforcement

Mellow may investigate suspected violations of this Policy.

Depending on the circumstances, Mellow may:

• Issue a warning
• Remove unauthorized progress
• Correct FP balances
• Remove improperly obtained unlocks
• Restrict features
• Suspend an account
• Cancel Premium access
• Terminate an account
• Block abusive activity
• Restrict devices or sessions
• Preserve relevant records
• Report conduct to appropriate authorities where legally required or reasonably necessary

Enforcement decisions may take into account:

• Severity
• Intent
• Repetition
• Harm caused
• Security impact
• Financial impact
• Risk to other users
• Previous violations

30. Immediate Action

Mellow may take immediate action without prior notice when reasonably necessary to address:

• Active security threats
• Fraud
• Unauthorized system access
• Malware
• Payment abuse
• Significant service disruption
• Threats to user privacy
• Illegal conduct
• Ongoing exploitation of a vulnerability

31. Correction of Illegitimate Progress

If Mellow reasonably determines that FP, achievements, virtual rewards, or unlocks were obtained through abuse, manipulation, fraud, or exploitation, Mellow may correct the associated account data.

This may include:

• Removing improperly earned FP
• Reversing unauthorized achievements
• Relocking improperly unlocked rooms
• Removing improperly obtained virtual rewards

Legitimate progress should not be removed solely because of ordinary technical discrepancies.

32. Mistaken Enforcement

If you believe your account was restricted or terminated in error, you may contact Mellow through the Contact page.

Mellow may review the circumstances but does not guarantee reversal of every enforcement decision.

33. Reporting Security Issues

If you discover a potential security vulnerability, please report it responsibly through Mellow’s Contact page.

When reporting a vulnerability:

• Describe the issue clearly
• Avoid accessing unnecessary personal data
• Avoid disrupting the Service
• Do not publicly disclose the vulnerability before Mellow has had a reasonable opportunity to investigate
• Do not exploit the vulnerability for personal gain

Responsible good-faith reports are encouraged.

34. Reporting Abuse

If you become aware of misuse of Mellow, you may report it through the Contact page.

Reports should contain enough information for Mellow to understand the issue.

Do not knowingly submit false or malicious reports about another user.

35. Changes to This Policy

Mellow may update this Acceptable Use Policy as the Service evolves, new features are introduced, security risks change, or legal requirements develop.

The Last Updated date will be revised when changes are made.

Material changes may be communicated through the Service or another reasonable method where appropriate.

36. Relationship to Other Mellow Policies

This Acceptable Use Policy forms part of Mellow’s Terms of Service.

If this Policy conflicts with the Terms of Service regarding prohibited or abusive use, this Policy provides the more specific rules for that subject.

By using Mellow, you agree to use the Service lawfully and not to interfere with Mellow’s security, subscriptions, Focus Point system, virtual rewards, users, or technical infrastructure.
